The Corrupt SCOTUS Is Mitch McConnell’s Fault

The problem with institutionalists is they all believe in magical thinking. Sorry, American journalism, but Mitch McConnell – the elected person most responsible for making the Dobbs decision happen – is not actually an institutionalist. Institutionalists care about institutions. McConnell cares about power – getting it, holding it, keeping it – the institution be damned. Ah, but – if Mitch can use the institution to achieve his ends?

Would Merrick Garland have made a better Supreme Court justice than an Attorney General? We’ll never know. Garland definitely couldn’t have done a worse job as SCOTUS judge than as AG. The fact that McConnell’s gerryrigged SCOTUS is about to deny justice (and perhaps even grant Trump unlimited power) sits, in part, at Garland’s feet. He dithered for a year over prosecuting Trump.

Garland feared being political. Holy shit. Since when did committing high crimes become political? That’s kinda our whole freakin’ problem! We’ve conflated political behavior (what Democrats do) with criminal behavior for a political purpose – the Republican operating principle. Those two things are not the same!

Cheating to win should not be “just another way to win”.

Ah, but scumbags like Mitch McConnell have made a career of normalizing cheating to win. That’s what you have to do when people won’t vote for your ideas. Either you stop those people from voting, or, if they do vote, you find ways not to count it.

Consider the legal means Trump has used to evade justice up until now. These are all expensive propositions to pursue. Poor folks couldn’t possibly afford to do them. That’s the point, I fear. Rich, white people with access to good lawyering have baked corruption into the architecture. But then, we have to remember that rich white people baked slavery into our Constitution, too.

Mitch McConnell has served Trump well. But, Trump wasn’t really the brains behind today’s chaos. Right wing money was. The Kochs. The Mercers. Harlan Crow. Leo Leonard.

As the Reagan Revolution faded away – and white power began to fade away with it – the Right Wing Money saw that two institutions stood between them and political oblivion: the SCOTUS and the Senate. If they could hold onto and control those two things (and as much of the judicial branch as possible), they could either withstand America diversifying or deny it entirely.

Deny political power to diverse Americans, that is.

Since this country’s founding, a third of us have never been down with democracy. There have always been royalists in our midst. Authoritarians – because that’s what royalists are at heart. They want a person telling them what to do, not the rule of law.

Mitch McConnell took a giant shit on the rule of law – and every single institution – when he denied Merrick Garland so much as a hearing. Mitch spouted a bunch of silly garbage about “the American people needing the right to choose” when, in fact, the American people HAD chosen – Barack Obama.

We had authorized Barack Obama – so long as he was still POTUS – to choose a justice (which the Senate would then vet). Was Mitch being an “institutionalist” when he denied We The People? No, he was working the early parts of the coup d’etat that became the January 8 Insurrection.

Mitch then flipped the script when Ruth Bader Ginsburg died. Suddenly, Mitch was in a rush – to fill a SCOTUS seat despite the fact that the majority of Americans had just voted AGAINST Donald Trump.

What is it about the will of the American People that Mitch hates so much? Oh, right – our diversity, our race, our sex, who we love and what we believe.

I’ve argued here on many occasions that Trumps presidency was not legit. How can one legitimately be president if a hostile foreign leader MAKES you president? Our laws don’t actually work that way; we’re just a little slow to realize it.

Mitch McConnell knows our laws don’t work that way. But, he’s doing everything in his nefarious power to change that.

  1. This, the most corrupt court in our recent memory – if not since the founding -, needs to be reeled in big time. They are purposely and deliberately legislating from the bench in order to preserve the corrupt and debased agenda of the conservative movement, pure and simple. They are not judges, they care not about instituions or original law, or anything else like it. They are a runaway political movement without limit, integrity, or morals.

    This is the great mistake of the founders; thinking that vermin like these scumbags couldn’t manage a hold on a civil institution with such awesome power and ride it for all its’ got! Boy were they wrong! But we need to make this right – and in any way possible. This court must be wiped clean of the Alito/Cavanaugh/Gorsuch/Barrett/and – of course – Clarence the Clown; the alleged sexual deviant that never should have been placed on the court to begin with and has now flaunted his slimy, scummy, milk-it-for-what-its-worth role on the “court”.

    This is no “court”, it is part of the Repugnantcan National Party and this must be changed, and in any way available.

    • Part of our problem is we’ve conflated political acts with criminal acts for a political end. Or, rather, we allowed all the rich, old, Christian white guys to equate their criminal acts with politics.
